1. Introduction
By placing an order with LUX Prosthetics LLC via this website or the phone, you agree to abide by all the terms and policies outlined in this agreement.
2. Limitation of Liability
LUX Prosthetics LLC shall not be liable for any incidental or consequential damages, including but not limited to inconvenience, lost wages, chair time, or pain and suffering.
3. Payment Terms
Pre-Payment Policy:LUX Prosthetics LLC operates on a pre-payment basis. Payment is required before work commences on your case. In rare instances where an invoice has been issued, it must be paid within 10 days of issuance. We provide a payment outlet on this website (via Stripe) or you may contact us to process the payment over the phone.
Payment Options: Credit/Debit Cards.
ACH or Check:
If you require this mode of payment, please arrange it with us directly.
Accounts with unpaid balances (over 10 days late) will be placed on hold until full payment is received.
Accounts remaining on hold for 60 days will be referred to our collection service, and all balances owed will incur an additional 25% service fee.
Accounts with unpaid balances forfeit any legal right to demand delivery of any prosthetic or service which they have ordered. Delivery is contingent upon full payment as specified in our pre-payment policy.
Returned Checks: A $50.00 fee will be charged for all returned checks.
4. Warranty
LUX Prosthetics LLC does not offer warranty for any services or devices provided to you. Our mission is to prioritize the best possible outcome with every case we work on and we strive to please our clients with high quality work and elite customer service.
5. Production Sites
USA based design and fabrication. "Made in the USA!"
6. Turnaround Times
Turnaround times mentioned on our website, platforms, or marketing materials are averages. While we strive to meet all turnaround times, we do not guarantee them for clients.
7. Prosthesis Insertion and Patient Maintenance
All prostheses must be inserted by a licensed practicing dentist. Clients are responsible for compliance with industry standard maintenance protocols (cleaning and examination) at their licensed place of business.
8. Remake Cases
Remake (for both digital designs and physical prosthetics) will be provided in an event that our design/prosthetic does not fit your recipient; or the prosthetic was delivered damaged; or that design/prosthetic was delivered vastly different from what was described on our website.
Remake cases are to be modeled on intraoral digital scans originally provided. If the remake needs to be created using new/updated scans resulting from changes in recipient's oral anatomy and/or additions of implanted devices, the remake will be charged as a new order.
Remake cases with instructions differing from the original case (e.g., shade, material, tooth shape, addition of support structure) will be charged as new order.
For shade remakes due to our error, the case will be refabricated at no charge, provided the remake uses the exact same shade as initially requested.
Any case can be remade at no charge under the conditions above only twice. The third remake and any subsequent remakes will be charged in full.
Additional Exclusions: Remakes resulting from accidents, neglect, abuse, failure of supportive tissue structures, improper case adjustments, or improper dental hygiene, will be charged as new order.
9. Cancellation Policy
Cancellation requests must be made within 24 hours from when the case is received by LUX Prosthetics LLC. Cancellation requests made after 24 hours are subject to being charged at full price.
10. Consent to Receive Communications
By submitting your information on any form on our website, you agree to receive communications from LUX Prosthetics LLC and its subsidiaries.
Types of Communications:
Phone calls.
Emails.
SMS/MMS messages.
Other forms of electronic communication.
Purpose of Communications: Customer care. Marketing purposes. Order updates. Appointment reminders. Newsletters. Promotional offers. Information relevant to our products and services.
Opt-Out Options: SMS Messages: Reply “STOP” to any SMS message to opt out. Email Communications: Follow the unsubscribe instructions provided in the email. Contact Us Directly: Call us to opt out.
Data Protection and Privacy: Your personal information will be handled in accordance with our Privacy Policy, available on our website. We are committed to safeguarding your information and complying with all applicable laws and regulations regarding personal data and electronic communications.
Compliance with Laws: LUX Prosthetics LLC adheres to all relevant laws and regulations, including but not limited to: CAN-SPAM Act Telephone Consumer Protection Act (TCPA) General Data Protection Regulation (GDPR) We ensure that your rights and preferences are respected.
11. Arbitration and Dispute Resolution
Agreement to Arbitrate:
By entering into a business relationship with LUX Prosthetics LLC, you agree that any and all disputes, claims, or controversies arising out of or relating to these Terms and Conditions, your use of our services, products provided, payment obligations, or any aspect of our business relationship (collectively, "Disputes") shall be resolved exclusively through binding arbitration on an individual basis, rather than in court.
Waiver of Court Proceedings and Jury Trial:
You expressly waive your right to file a lawsuit in any court, to have a trial by jury, and to participate in a class action or class arbitration. All Disputes must be resolved through individual binding arbitration as described herein. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16).
Arbitration Procedures:
Arbitration shall be conducted in Pinellas County, Florida, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitration shall be conducted by a single arbitrator mutually agreed upon by both parties, or if no agreement can be reached, appointed by the AAA. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.
Client Responsibility for Arbitration Fees:
You agree that you shall be responsible for and shall pay all costs and fees associated with the arbitration proceedings, including but not limited to: arbitrator fees, AAA administrative fees, filing fees, hearing fees, and any other costs incurred in connection with the arbitration. You shall also be responsible for your own attorney's fees and costs. In the event LUX Prosthetics LLC is the prevailing party in the arbitration, you agree to reimburse LUX Prosthetics LLC for all reasonable attorney's fees, costs, and expenses incurred in connection with the Dispute.
Governing Law and Venue:
These Terms and Conditions and any Disputes shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any arbitration proceedings shall take place in Pinellas County, Florida.
Severability:
If any portion of this arbitration agreement is found to be unenforceable or unlawful for any reason, the remainder of this arbitration agreement shall continue in full force and effect.
Survival:
This arbitration agreement shall survive the termination of your business relationship with LUX Prosthetics LLC and shall continue to govern any Disputes that arise from or relate to the relationship between the parties.
12. General Provisions
Baseline Dental Standards: The client agrees to adhere to baseline dental standards and technical recommendations, whether listed above or not. Changes to Terms and Conditions: All conditions listed above are subject to change. We reserve the right to modify these terms and policies at any time. Any changes will be effective immediately upon posting to our website or by other means of notification. Acceptance of Terms: Your continued use of our services constitutes acceptance of these terms and any updates thereto.
13. Shipping Policy
LUX Prosthetics LLC’s standard shipping methods are as follows: UPS 2nd Day Air. UPS 3 Day Select. Clients may not request alternate shipping carriers such as USPS, FedEx, DHL, or others in place of the assigned UPS service. However, clients who wish to use another carrier may provide their own pre-paid shipping labels. While LUX Prosthetics LLC will make reasonable efforts to accommodate such requests, accommodation is not guaranteed and depends on whether the carrier is a major service provider and compatible with our processes.
